1. Who you are contracting with
These Terms govern your use of the Conglomerate WARD service (the "Service"), operated by Conglomerate ("we", "us", "our"). By accessing or using the Service you agree to these Terms.
2. The Service
Conglomerate WARD is a daily emotional journaling tool that lets you log short blocks of text, optionally enter an extended WARD entry, and submit a Song of the Day. Subscribers may receive human written responses to WARD and Song of the Day submissions.
3. Acceptable use
You agree not to misuse the Service. In particular you must not:
- use the Service for unlawful, fraudulent or abusive purposes;
- upload content that infringes intellectual property or privacy rights;
- send spam, malware, or attempt to probe, scan or compromise the Service;
- scrape, reverse engineer, or resell the Service or its content.
4. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
5. Intellectual property
Conglomerate and its licensors own the Service, including all software, design, branding and documentation. You retain ownership of the content you submit, and grant us a limited licence to host, process and (where you are a subscriber) respond to that content solely to operate the Service.
6. Subscriptions, payment & billing
Paid subscriptions are billed monthly at the price displayed on our Pricing page (currently R198.80 per month). Your order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries relating to payments and handles refunds. Payment, billing, tax and cancellation mechanics are also governed by the Paddle Checkout Buyer Terms.
Subscriptions renew automatically each month until cancelled. You can cancel at any time from the in-app subscription management link; cancellation takes effect at the end of the current billing period.
7. Refunds
Subscriptions are covered by a 30-day money-back guarantee. See our Refund Policy for full details. Refunds are processed by our payment provider, Paddle.com, in line with Paddle's Refund Policy. To request a refund, contact us through the in-app support channel or look up your order at paddle.net.
8. Service availability & warranties
We do not warrant that the Service will be uninterrupted, error-free or secure. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our acceptable use rules. You may stop using the Service at any time.
10. Liability
To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental or punitive damages, including loss of profits, data or goodwill.
11. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa, and disputes are subject to the exclusive jurisdiction of its courts.
